Terms of Use
These terms are the agreement between you and Ponder Technologies Inc. when you use the CAW website or app, and especially when you capture as a spotter. They are written to be read. If you create an account or start a capture session, you are agreeing to them, and to the Privacy Policy, which is part of this agreement.
1. Who can use CAW
You must be at least 18 years old, legally able to work in the place where you capture, and able to walk your chosen zones safely. One account per person; keep your credentials to yourself and tell us if you believe your account is compromised.
2. What spotting is, and is not
Spotting is independent work, not employment. You choose whether, when, and which zones to walk. You are an independent contractor: no shifts, no quotas, no employment relationship, no benefits, and you are responsible for your own taxes on earnings. Nothing in these terms creates an employment, agency, or partnership relationship.
3. Spotter conduct: the rules of a capture
The streetscape is the subject. People never are. Every rule below flows from that.
- Stay on public rights-of-way. Capture only from public sidewalks, paths, and spaces. Never enter private property, and never point the capture into windows, backyards, or any private space.
- Never target people. Do not follow, focus on, or deliberately photograph individuals, children, licence plates, or identifiable private activity. If someone asks not to be captured, stop, let them pass, and continue.
- Safety first, capture second. Obey traffic laws and signals, stay aware of your surroundings, do not capture while crossing, and stop the session if conditions are unsafe. You are responsible for your own safety while walking.
- No manipulation. Do not fabricate, stage, geospoof, or artificially inflate captures, and do not submit imagery you did not capture yourself during the session. Test and demo modes exist for practice and are labeled as such.
- Follow the route in spirit. Minor deviations for safety or obstructions are fine; capturing a different area than the assigned zone is not.
- Local law applies. You are responsible for complying with the laws of the place you capture in, including trespass, traffic, and filming rules.
Violating these rules can lead to rejected sessions, forfeited pending credits related to the violation, or account termination. Deliberate privacy violations lead to immediate termination.
4. Payments
- How earning works. Each zone lists its rate per capture point and any completion bonus before you accept it. Submitted sessions are reviewed; approved sessions credit your balance at the listed rates. Sessions may be rejected for quality, conduct, or authenticity issues, with the status visible in your app.
- Payouts are made by e-transfer to your account email. Balances, credits, and payouts are all visible in the app, down to the cent.
- Zone availability is not guaranteed. Zones open and close with customer demand and coverage needs; CAW does not promise any volume of available work or earnings.
- Errors. Demonstrable crediting errors can be corrected in either direction; we will tell you when that happens.
5. Rights in captured content
When you upload capture data through CAW, you assign to Ponder Technologies Inc. all rights, title, and interest in the captured imagery and telemetry, and where assignment is not possible you grant Ponder Technologies a perpetual, irrevocable, worldwide, royalty-free licence to use it for any purpose, including analysis, model training, and delivery to customers. Compensation for captures is the payment described in section 4. Ponder Technologies handles imagery under the commitments of the Privacy Policy, including blurring faces and licence plates before imagery is reviewed, analyzed, or delivered.
6. Your account and data
You can stop using CAW at any time, and you can request account deletion as described in the Privacy Policy. Earned balances at closure are paid out subject to review of pending sessions. We may suspend or terminate accounts that violate these terms, with any legitimately earned balance still paid.
7. The service is provided as-is
CAW is an early-stage service. It is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose. We do not warrant uninterrupted operation, and features may change as the network develops.
8. Limitation of liability
To the maximum extent permitted by law, Ponder Technologies Inc. is not liable for indirect, incidental, special, or consequential damages, or for loss of earnings opportunity, arising from your use of CAW. Our total liability for any claim is limited to the greater of CAD $100 or the amounts credited to your spotter balance in the three months before the claim arose. Nothing in these terms limits liability that cannot be limited under British Columbia law.
9. Indemnity
You agree to indemnify Ponder Technologies against claims arising from your violation of these terms, including capture conduct that breaks the rules in section 3 or the law.
10. Changes
We may update these terms as the service evolves. The effective date above always reflects the current version, and material changes are notified to account holders by email or in the app before they take effect. Continuing to capture after a change takes effect is acceptance of it.
11. Governing law
These terms are governed by the laws of British Columbia and the federal laws of Canada applicable there. Disputes are subject to the exclusive jurisdiction of the courts of British Columbia, sitting in Vancouver.
